Transparency in conflicts of interest
Transparency of conflicts of interest is identified by the legislator as one of the ways to build confidence in the drug safety system.
To this end, the law dated 29 December 2011 on strengthening the health safety of medicinal products and devices stipulated the obligation to publish links between companies producing or marketing products for health or cosmetic purposes and 9 categories of health care stakeholders.
The decree dated 21 May 2013 determines the nature of the information and the methods used to publish these conflicts of interest.
Under this decree, some personal data can be published on the website at www.groupebatteur.fr. The Batteur Group is responsible for processing the information and shall ensure that the data are processed fairly and lawfully in accordance with the "Data Protection" legislation dated 6 January 1978, duly amended. The latter commit to only collect data which is strictly relevant and necessary to the aforementioned purposes. Data may also be sent by the Batteur Group to the professional association’s tribunals and to any other tribunal authorised to receive them. All of the information published by the Batteur Group comply with current regulatory provisions. Any person whose personal data is published may not dispute such distribution. Conversely, and in accordance with the "Data Protection" Act dated 6 January 1978 and decree No. 2005-1309 of 20 October 2005, an individual has the right to access and correct any personal data. The individual can exercise this right by contacting the Groupe Batteur Data Protection Officer in writing at the following address: avenue du Général De Gaulle 14200 Hérouville Saint-Clair.
